Legislation

The Department of Fire and Emergency Services (DFES) was established on 1 November 2012 as a government department.

DFES administers the following Acts on behalf of the Minister for Emergency Services; Corrective Services; Small Business; Veterans.

  • Fire and Emergency Services Act of 1998
  • Fire Brigades Act 1942
  • Bush Fires Act 1954
  • Emergency Services Levy Act 2002

The Emergency Management Act 2005 was formerly administered by DFES. It is now administered by the State Emergency Management Committee (SEMC).

Local governments also have responsibilities under the Bush Fires Act 1954 in relation to preventing and responding to bushfires in addition to establishing and running volunteer bush fire brigades.

Legislation Review

The Department of Fire and Emergency Services is progressing the review of our current emergency services Acts (the Fire Brigades Act 1942, the Bush Fires Act 1954 and the Fire and Emergency Services Act of 1998) to create a single comprehensive Emergency Services Act which will improve community safety and better support all of our emergency services workers into the future.
